SB 330 -- CHILD SUPPORT ORDERS
SPONSOR: Caskey (Cooper, 120)
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Children and Families by a vote of 13 to 0.
Currently, court orders requiring the withholding of an obligated
parent's income and orders requiring a parent to provide health
insurance for a minor child must be sent to employers via
certified mail. This bill allows notice of these orders to be
sent via regular mail.
FISCAL NOTE: Estimated Net Savings to General Revenue of
$177,502 in FY 2004, $219,481 in FY 2005, and $226,065 in FY
2006.
PROPONENTS: Supporters say that the bill allows withholding
orders and enrolling orders to be sent through regular mail. It
is a cost savings measure, since regular mail is less expensive
than certified mail. If the withholding or enrolling order sent
through regular mail is not honored, the Division of Child
Support Enforcement will re-send the order through certified
mail.
Testifying for the bill was Senator Caskey.
OPPONENTS: Those who oppose the bill say that they oppose
sending the orders by regular mail because they are legal
documents, and there are penalties for employers who do not
comply with the orders.
Testifying against the bill was Dr. Robert Olsen.
